Thank you for visiting Singapore Electronic Gazette website (the “Website”). Your access and use of the Website constitutes your acceptance of and agreement to be bound by these Terms of Use. If you do not accept these Terms of Use, please discontinue your access and do not use the Website.

Amendments

  1. These Terms of Use may be amended from time to time without prior or further notice to you. Your use of the Website after any amendment to these Terms of Use will constitute your acceptance of the amended Terms of Use.

Proprietary Rights

  1. The Website is owned and maintained by the Government of Singapore (the “Government”), represented in these Terms of Use by the Ministry of Digital Development and Information (“MDDI”). It is the online repository and platform for publication of electronic Government Gazettes (“e-Gazettes”).

  2. The materials, including but not limited to the e-Gazettes, as well as other text, compilations, graphics, images, software programs and all other kinds of works, comprised in or displayed on the Website (“the Contents”) are protected by copyright, trademark and other forms of proprietary rights. All rights, title and interest in the Contents are owned by, licensed to or controlled by the Government.

  3. For avoidance of doubt, section 48 of the Interpretation Act (Cap. 1) does not apply to anything printed, downloaded or copied from the Website.

Restrictions on Use

  1. Except as set out in clause (11) of these Terms of Use, the Contents shall not be reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way, without the prior written permission of MDDI.

  2. Modification of any of the Contents, or use of any of the Contents for any unauthorised purpose, will be a violation of the Government’s copyright and other intellectual property rights.

Disclaimers of Warranties and Liability

  1. The Contents are provided without warranties of any kind. To the fullest extent permitted by law, the Government does not warrant and hereby disclaims any warranty:

    1. as to the accuracy, correctness, completeness, reliability, timeliness, non-infringement, title, merchantability or fitness for any particular purpose of the Contents;

    2. that the Contents, or any functions of or available through the Website, will be error free or available without delay or interruption, or that defects will be corrected, or that the Website and the server hosting the Website are and will remain free of any viruses and/or other harmful elements.

  2. The Government shall also not be liable for any damage, loss or liability of any kind (whether actual, anticipated, consequential, special, economic or otherwise) caused as a result (direct or indirect) of the use of, or inability to access or use, the Website, including but not limited to any damage, loss or liability suffered as a result of reliance on the Contents.

Right of Access

  1. The Government reserves the right to deny or restrict access to the Website to any particular person, or to block access from a particular Internet address to the Website, at any time and without ascribing any reason or giving any notice.

Reproduction of legislation-Gazettes

  1. The Government has granted permission to the users of the Website to reproduce any e-Gazettes in any print or electronic material or platform (collectively, “the relevant material/platform”), subject to these Terms of Use and the following conditions:

    1. the following information must be included in the relevant material/platform:

      1. that the e-Gazettes are subject to copyright of the Singapore Government and are reproduced in the relevant material/platform with the permission of the Singapore Government;

      2. that the users of the relevant material/platform may check the Website for the latest e-Gazettes;

    2. the producers* of the relevant material/platform are responsible for ensuring the accuracy of the e-Gazettes reproduced in the relevant material/platform;

      * “producers of the relevant material/platform” means —

      1. where the relevant material/platform is a printed or electronic material (such as a book) — the authors and publishers of the printed or electronic material; or

      2. where the relevant material/platform is an electronic platform — the owners and operators of the electronic platform.

    3. the reproduction of the e-Gazettes on the relevant material/platform must not create any suggestion that the Government or the Website is associated or affiliated in any manner with the relevant material/platform, the producers of the relevant material/platform or the producers’ affiliates;

    4. in the case where the producers, or the producers’ affiliates or agents, intend to extract the e-Gazettes from the Website through automated means, such extraction of the e-Gazettes from the Website is subject to these Terms of Use and the following conditions:

      1. the extraction must not be carried out in an abusive or intrusive, or a deceptive, manner;

      2. the extraction must not disrupt or affect the Website’s performance, cause any harm or damage to the Website, or breach or circumvent of the Websites security measures.

  2. The Government may, at any time and without ascribing any reason or giving any prior notice, revoke the permission, or modify the permission or the conditions of the permission, granted under clause (11) of these Terms of Use.

Links from the Website to other websites

  1. The Website contains hyperlinks to websites which are not maintained by the Government . The Government is not responsible for the contents of those websites and does not endorse the opinions or views expressed in them. The Government shall not be liable for any damage, loss or liability of any kind (whether actual, anticipated, consequential, special, economic or otherwise) arising from the use of the hyperlinks or access to those websites. Use of the hyperlinks and access to such websites are entirely at your own risk.

  2. Hyperlinks to other websites are provided for your convenience. Under no circumstances shall the Government be considered to be associated or affiliated with any trade or service marks, logos, insignia or other devices used or appearing on websites to which the Website is hyperlinked.

  3. The Government reserves the right to remove or disable any hyperlink to any website on the Website, at any time and without ascribing any reason or giving any notice. The Government shall not be liable for any damage, loss or liability of any kind (whether actual, anticipated, consequential, special, economic or otherwise) caused as a result (direct or indirect) of the removal or disabling of any hyperlink.

Links to the Website from other websites/electronic platforms

  1. Except as set out below, caching and links to, and the framing of, the Website (or any part of it) or any of the Contents are prohibited.

  2. The Government has granted permission to the users of the Website to create hyperlinks to the Website in the users’ websites/electronic platforms, subject to these Terms of Use and the following conditions:

    1. when the Website (or any of the Contents) is accessed through a hyperlink provided in the user's website/electronic platform, the entire page of the Website (with the Website's banner and logo) must be displayed as it is;

    2. the Contents (or any part of it) or the Website (or any part of it) must not be embedded or framed within the user's website/electronic platform;

    3. without limiting clause (21) of these Terms of Use, the hyperlinking must not create any suggestion that the Website or the Government is associated or affiliated in any manner with the user, the user’s affiliates and/or the user's website/electronic platform.

  3. You must obtain MDDI’s written permission prior to framing the Website (or any part of it) or any of the Contents, or engaging in similar activities. MDDI may, at its sole and absolute discretion, grant (on such conditions as MDDI deems fit) or refuse permission for the framing of the Website (or any part of it) or any of the Contents.

  4. The Government may, at any time and without ascribing any reason or giving any prior notice, revoke any permission, or modify any permission or the conditions of the permission, granted under clause (17) or (18) of these Terms of Use.

  5. Your linking to, or framing of, the Website (or any part of it) or any of the Contents constitutes acceptance of these Terms of Use (including any amendment to these Terms of Use after the hyperlinking or framing). If you do not accept these Terms of Use, you must immediately discontinue linking to, or the framing of, the Website or the Contents.

  6. Under no circumstances shall the Government be considered to be associated or affiliated with any trade or service marks, logos, insignia or other devices used or appearing on websites/electronic platforms that link to or frame the Website (or any part of it) or any of the Contents.

  7. MDDI reserves the right to disable any unauthorised links to, or frames of, the Website (or any part of it) or any of the Contents, at any time and without ascribing any reason or giving any notice.

  8. Without limiting clause (22) of these Terms of Use, MDDI reserves the right to, at any time and without ascribing any reason or giving any notice, disable any link to, or any frame of, the Website (or any part of it) or any of the Contents in any website/electronic platform containing inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful material or information, or material or information that violates any written law or any applicable intellectual property, proprietary, publicity or other rights.

  9. MDDI reserves the right to change the URL of the Website or any part of it, at any time and without any notice.

  10. The Government shall not be liable for any damage, loss or liability of any kind (whether actual, anticipated, consequential, special, economic or otherwise) caused as a result (direct or indirect) of the disabling of any link or frame under clause (22) or (23) or the changing of any URL under clause (24) of these Terms of Use.

Governing Law

  1. These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any claim relating to use of the Website or any of the Contents shall be exclusively heard by the Singapore Courts.
